The terms and conditions set forth below govern your access to and use of the website www.accountants.com.mt.  By making use of any service provided on this website, you will be deemed to have read through and accepted these terms and conditions.  If you do not agree with these terms and conditions, kindly refrain from using the site.

We reserve the right to change or update from time to time any of the following terms and conditions.  Such changes will become effective when published and you should therefore periodically review this page to ensure familiarity with the most updated version of the terms of use.

1. Definitions

‘Accounting Professional’ refers to any individual who creates an online profile on the website for the purposes of applying for accounting jobs.

‘Data Protection Act 2010’ refers to Chapter 440 of the laws of Malta.

‘Client’ refers to any firm advertising accounting job opportunities on the website.

‘User’ refers to an accounting professional, client or any other third party making use of or accessing any parts of the website.

‘Website’ refers to www.accountants.com.mt, sometimes referred to below as ‘site’, ‘we’, or ‘us’.

2. Accounting Professional

2.1 An accounting professional may create and use only one account.  On creating an account, the accounting professional undertakes to (a) provide accurate and complete information about his personal details and qualifications and (b) maintain and update this information to keep it accurate and current.

2.2. An account must be created solely for the purpose of searching and applying for accounting jobs posted on the website.  We reserve the right to suspend or terminate access to any account on suspicion that it is being used for any other purpose.

2.3. An accounting professional is prohibited from contacting clients for any other reason other than to apply for an accounting job.

2.4. An accounting professional is prohibited from applying for job opportunities listed on the website on behalf of anyone other than himself.

2.5. On applying for a job opportunity listed on the website, accounting professionals give their consent to make available their personal and contact details to the client.

2.6. On registering an account, accounting professionals give their consent to receive emails about job opportunities that match their set preferences. Accounting professionals can unsubscribe or re-subscribe to the mailshot at any time from their account profile.

2.7. An accounting professional is responsible for the confidentiality of his username and password and consequently solely and entirely responsible for all activities conducted through his account.  We accept no responsibility for the unauthorised access to any profile which arises from the negligent disclosure of passwords to third parties.

3. Client

3.1. The client agrees to use the website for the sole purpose of posting accounting jobs.  We reserve the right to decline the posting of job opportunities which are not related to the accounting profession.

3.2. In order to be able to post jobs on the site, the client is required to register with us.  On registration, the client undertakes to (a) provide accurate and complete information about himself and (b) maintain and update this information to keep it accurate and current.  Should any of the information provided be found to be untrue or inaccurate, we reserve the right to terminate your access to the site.

3.4. The posting of job opportunities on behalf of any third party is strictly prohibited.  Recruitment agencies are not allowed to advertise job openings on this website.  Firms may only post job opportunities on their own behalf.

3.5. The client shall refrain from advertising multiple positions within one job posting.  Each job posting must refer to one job opportunity.

3.6. The client undertakes to provide accurate and sufficient information about a job opening to enable an accounting professional decide whether he/she is suited for that particular opportunity.

3.7. The client agrees to abide by the principle of confidentiality and comply with the provisions of the Data Protection Act 2001 with respect to any information about accounting professionals that is obtained from the website.  Reselling or otherwise making available any such information to third parties is strictly prohibited.

3.8. The client is prohibited from using the contact information of accounting professionals obtained through the website for any other purpose unrelated to the job posting such as for unsolicited mass marketing via e-mail or telephone.

3.9. The site does not get involved in the actual vetting of a particular candidate for a job.  The client is solely responsible for screening and determining whether a particular accounting professional is suited for the accounting job being advertised on the site.

3.10. We do not guarantee that the posting firm will successfully find a candidate for the advertised jobs.  Unsuccessful job postings will not be entitled for a refund.

3.11. The client undertakes to terminate before the specified closing date any job postings which are no longer available.

3.12. The client is responsible for the confidentiality of his username and password and consequently solely and entirely responsible for all activities conducted through his account.  The client shall refrain from sharing this login information to third parties.  We accept no responsibility for the unauthorised access to any account which arises from the negligent disclosure of usernames and passwords to third parties.

4. Courses

4.1. Participants can book a place for courses via the website. We accept online payments for the courses via PayPal, credit cards and bank transfer. Prices quoted on the website are inclusive of VAT.

4.2. Any payment that you make is subject to acceptance by us. When you make your payment we will send you an email with an official receipt and confirmation of booking. We may refuse or be unable to process your booking if your card or PayPal account does not give authorization for the payment.

4.3. The course will be held on the scheduled date and time. We reserve the right to re-schedule a course to a different date and / or time. Users who are not able to attend the course at the new date and / or time, will be entitled to a full refund of the price paid.

4.4. We reserve the right to close the bookings for a particular course once the maximum amount of participants allowed is reached.

4.5. We reserve the right to cancel any course up to 1 week prior to the course date. In case of cancellation, amounts paid will be fully refunded. We do not accept any liability for costs or damages caused to the participant as a result of a cancellation.

4.6. Participants are allowed to cancel their participation to a particular course up to two hours before its scheduled time by sending us an email. Upon cancellation, users will be entitled to a credit which can be used on a future course of their choice. Credits do not have an expiry date.

4.7. All of our courses will be held in a virtual classroom. We will send an online link to join the course via email to all booked participants a few days prior to the scheduled date of the course.

4.8. For a better course experience, users are advised to watch on a laptop or desktop device and use headphones.

4.9. To ensure a smooth delivery, participants are encouraged to ask questions only when it is indicated by the speaker.

4.10. Participants shall refrain from recording or otherwise making available the course or any material provided to any third parties who have not booked for the course.

4.11. Attendance at our courses can be claimed as CPE as detailed on the course information. A certificate of attendance will be sent by email after the course.

4.12. Participants understand and agree that the courses will only provide information for educational purposes and this information should in no way be treated as professional advice. In case of doubt, participants should always seek professional advice. We will accept no responsibility for any reliance that you may place on any material posted on our website or provided during the courses. Nothing listed on the website or provided during the courses is intended to amount to advice on which you should rely on.

5. Liability

5.1. Although all precautions will be taken, we do not warrant that the use of the site will be uninterrupted or secure and that the site and the server on which it is hosted are free of viruses or other harmful material.  The user assumes responsibility and risk for the use of the site and consequently, the site does not assume liability for any loss or damage, financial or otherwise, suffered by the user which is the result of circumstances beyond our reasonable control.

5.2. The site aims to establish a direct contact between clients and accounting professionals and it does not get involved into any negotiations between the two.  The site cannot authenticate the identity of the users of the site.  Consequently, users accept responsibility for all the risks associated with dealing with third parties with whom contact is established through the site and agree to release the site from any liabilities, claims, or damages of any kind and nature arising out of relationships established through it.

5.3. The site cannot certify the accuracy and completeness of information that is posted on it.  It is the sole responsibility of the user to verify any information transmitted through the site.  Consequently, we do not assume responsibility for any inaccurate job details or information about accounting professionals that is forwarded to clients and are not to be held liable for any liabilities, claims, or damages arising therefrom.

5.4. The site cannot guarantee that any application for any job posting available on it will be successful and is not to be held liable for any loss arising therefrom.
